Understanding Lemon Law - A Guide to Protecting Your Consumer Rights

Whether your vehicle is covered by lemon law or not, it is a good idea to seek legal advice from an attorney who can guide you through the process. They can help you prepare documentation and support your claims in court.

Whether your car is eligible for Lemon Law buyback or replacement depends on the defect type and how many repair attempts have been made. Robison Lemon Law Group focuses on helping consumers receive compensation for their defective vehicles.

The Song-Beverly Consumer Warranty Act
The Song-Beverly Consumer Warranty Act, also known as California's lemon law, is a piece of state legislation that helps level the playing field between automobile manufacturers & car dealers. This law covers various consumer goods and can allow you if you've purchased a new vehicle with serious issues that prevent it from operating as intended.

Cars are prone to several manufacturer defects, faulty parts, & serious issues that could render them useless. For many consumers, buying a new or used vehicle is one of their most significant financial decisions. Unfortunately, these defects may leave you stranded on the side of the road or without a functioning vehicle to get to work.

To invoke the lemon law, you must be able to demonstrate that your car is a lemon after it has undergone a reasonable number of repair attempts. This is based on repair records and when the car was out of commission.

Once you prove your car is a lemon, the manufacturer must repurchase or replace it. This law may also entitle you to any taxes and registration fees you paid for the vehicle in addition to the reimbursement of the purchase price. It's vital to remember that not all consumers will be eligible under this law and that the criteria may be difficult to meet. See a top California lemon law attorney to determine if you qualify for the state's safeguards.

The Magnuson-Moss Warranty Act
Federal legislation called the Magnuson-Moss Warranty Act aids in defending state-level consumers from faulty or subpar consumer goods. Additionally, it precludes producers from attempting to deny consumers' rights via a clause in a contract that is frequently included in product or vehicle purchase agreements. These rights can be explained, and an expert lemon law attorney can assist you in submitting a claim.

According to the law, a lemon is a car, appliance, or other consumer good with a significant mechanical flaw that can't be fixed after a fair number of efforts. It covers vehicles under warranty, but it also extends to other products akin to cars in terms of use and value.

Under the law, if a consumer successfully claims, they can get a refund, replacement vehicle, or cash compensation from the car manufacturer. Some states, including New York, allow consumers to recover their attorneys' fees.

Before filing a claim under the Magnuson-Moss Act, a consumer must participate in a state-run arbitration program or the manufacturer's dispute resolution system. Having an experienced lemon law attorney on your side can help ensure you receive the compensation you deserve.

Keeping up with your payments is important if your vehicle is financed or leased. Failure to do so could result in repossession and negatively impact your case. Once your case resolves, you can typically use the settlement funds to pay off what remains of your auto loan or lease and then seek a new vehicle without the persistent problems of your old one.

The Uniform Commercial Code
The Uniform Commercial Code (UCC) rules govern all goods or services transactions. While it does not specifically address lemon laws, it does impose guidelines to prevent manufacturers from drafting unfair warranties.

A manufacturer's written warranty usually accompanies the purchase of most new vehicles. This warranty promises that any defects covered will be repaired within a specified time and mileage limit. If the manufacturer fails to repair the defect after a reasonable number of attempts, a car buyer may qualify for lemon law protection.

When filing a lemon law claim, keeping all repair orders, sales or lease contracts, financing documents, and any other records related to the vehicle purchase is important. These documents will be helpful to a lemon lawyer, who will review them to ensure that all necessary information is included in a case.

The attorney will contact the manufacturer to discuss a resolution if the car is a lemon. Depending on the state, this can involve participating in a dispute settlement program or bringing a lawsuit.

If the manufacturer cannot agree to a solution with the consumer, the court can award compensation as a cash payment or replacement vehicle. Sometimes, the court may also award attorneys' fees to the successful consumer.

The Texas Deceptive Trade Practices Act
Lemon law originally referred to laws designed to protect consumers who bought defective automobiles. Still, it has since evolved to cover various consumer goods and services. The Texas Deceptive Trade Practices Act (DTPA) prohibits many business practices deemed false, misleading or deceptive. It allows consumers to sue for damages when these bad actors harm them.

The DTPA can be used with lemon laws and other consumer protection statutes, such as the Uniform Commercial Code and financial consumer protection laws. A local lemon law attorney can help consumers understand these other statutes and how they can apply to their situations.

Generally speaking, a vehicle is considered a lemon if it has been out of service for a significant amount of time due to repair attempts or if the manufacturer has not satisfactorily resolved the major defect in a reasonable number of attempts. The exact criteria vary by state, so you will want to work with a local lemon law attorney familiar with your jurisdiction's rules.

Most states require consumers to first participate in the manufacturer's arbitration program if it complies with federal regulations and the state lemon law before filing a lawsuit for relief under the law. A local lemon law attorney can help you navigate this process and may also be able to help you win your case in court even if the manufacturer chooses to arbitrate the dispute.

Toyota Hi-Ace Commuter: A Short Review

We had our dream car 4 years ago but it was only now I am sharing insights with the Toyota Commuter which we named “Atoy”. I am not sharing the main specifications like engine, under chassis, etc. I will just share more of its physical attributes.

We availed the Atoy through Auto Loan. If you wanted to know how much will be needed to own a Toyota commuter, including the monthly amortization,  you can visit the bank or car dealer near you.

Large Seating Capacity
Toyota Commuter can accommodate up to 15 passengers.

When we purchased it, Kuya Matthew used to occupy the first row. He placed a pillow and comfortably lie down. When our bunsoy Aiden arrived, he was the one occupying the second row thru the car seat. Sitting beside him is Mommy while Kuya already occupies the passenger seat in front.

Having a large capacity vehicle is important to us since we have our bunsoy. Whenever we travel and spend our vacation in Nueva Ecija, we can bring all the things needed like the stroller, high chair seat, and even the bathtub for him.

Comply with the COVID-19 Guidelines
One of the requirements during the height of the pandemic is the social or physical distancing in both public transportation and private vehicle. Since Atoy is spacious, the minimum health guidelines are being met. We can still accommodate up to 10 people during our travel.

Can Climb High Slopes With Ease.
The first place with a steep slope we visited is the Monasterio in Tarlac. The place is located on top of the mountain and I thought Atoy will have difficulty in climbing the steep road. However, we reached the place at 3rd or 4th gear with ease.

Then, we re-visited Monasterio with a full passenger (15 people). Still the same, the engine is running between 3rd and 4th gear at slopes without hesitations.

Removable Seats
The seats are detachable and you can remove several rows if needed. This will accommodate more stuff especially if there are only a few passengers on board.

Last time, we were able to contain a 16 cubic foot refrigerator by removing the two last rows and traveling around 100 kilometers.

High Platforms
One of the problems during rainy days is the temporary flooding in low-lying areas. One time, we went to need to buy stuff. However, on our way to the grocery heavy rain pours. One of the roads is already submerged in water. Without a second thought, we managed to pass the flooded area. The water is just half of the tire deep and did not reach the possible entry of water.

Here are more of the specifications for the Toyota Hi-ace Commuter.

Dimension: 4,695mm x 1,695mm x 1,980mm
Wheelbase: 2,570mm
Seating Capacity: 15
Engine type: 4-cylinder L Type
Engine Displacement: 2,982cc
Maximum Output: 136ps/3400rpm
Minimum Torque: 300nm/1,200-2,400mm
Fuel Capacity: 70 Liters
Transmission: 5-Speed Manual (Dash-Mounted)
Front Brake/Rear Brake: Ventilated Discs/Drums
Tires: 195R 15C
Wheel Size: 6JJ x 15”

You can visit Toyota Showrooms if you want to see the Hi-Ace commuter. You can also check the bestselling Toyota models.

The Most Important Tips For First-time Family Car Buyers

In 2017, victims of online car buying scams lost more than 64 million and more than 17,000 cases of auto frauds were reported, according to the National White Collar Crime Control. Fraud, overpricing, and poor vehicle condition are among the most common problems that oblivious buyers experience. Purchasing a vehicle is one of the most significant risks one can make, especially if you do not know much about vehicles. How should you avoid scammers and untruthful salespersons? The answer to this is conducting sufficient research before visiting any dealership to ensure safety and to make the best of your purchase regarding price.

Do your research

"When buying a car from a dealer, many people start backward by visiting the dealership before doing research," Jim Davidson, president of Carsmart told the star. He termed that as the worst thing to do because you might fall prey to pressure from salespeople and misinformation. "You want to buy the car that is best for you, and your family's needs, not necessarily what the dealer wants to sell that week. You should walk away from such pushy people," said Terry O'keefe of Ontario Motor vehicle Industry Council. When doing your homework, always keep in mind that online reviews can be fake and biased. In that line, Davidson advises using Consumer Reports, which is a non-profit organization that helps consumers make the most informed decisions.

Go for a test-drive and see a mechanic

Once you have settled on a model that suits your family’s needs, Davidson recommends visiting a minimum of 3 dealerships so that you get the best deal and that you should be clear you want to test it on the road. While driving the vehicle, take it to the highway, especially if it is a second hand. Bringing it to higher speeds could help identify any mechanical problems. Also, make sure to bring with you someone who understands the car in case you encounter difficulties.

"It would be a huge risk to turn money over to a private seller especially without getting a history report," O'Keefe says. He also advises that while asking for a history report is vital, a mechanic is better because they can find things that the seller failed to mention or did not even know about. Taking a car to a mechanic also helps to fish out scams and curbsiders, increasing your confidence about both the vehicle and the dealership.

O'Keefe recommends consumers to ask some serious questions to ensure they are not being scammed. These include how long the seller has owned the car if they have maintenance records and the reason for selling the car. In addition, whether you are buying a new or a used car, it is imperative that you know your rights as a buyer. This is particularly of use when it comes to signing contracts. "Many people assume that there is a cooling-off-period for all kinds of transactions, but there is none for vehicles. Do not sign a contract unless you are certain you want to complete the sale, " he says.

Latest Car Safety Features Must Haves

This is a sponsored post. All opinions are mine.

If you have plans to buy a new car, it's safety must be on your top list. Good thing is that today's new cars are packed with safety features that help protect drivers and passengers as well as pedestrians. Now, what car safety features to look at when buying a new one?

Car Safety Features, cars
source
Here are the latest car safety features must haves you need to consider for your next vehicle.

Safety-belt Features

Seatbelt is one of the most importance piece of safety equipment. When a car crash happen, seat belts will keep you inside the car reducing the risk of colliding with the steering wheel, dashboard or windshield. Today seat belts has enhanced features to improve seat belt performance.

Seatbelt pretentioners retract the seat belt to remove excess slack during frontal impact. Adjustable upper belts allow you to change the position of the shoulder strap to adjust to a person's size making it more comfortable thus encouraging its use. There are car models that offer inflatable safety belts in the rear seat, which further reduce force of the belts on the back passengers during accident then spread the forces over a wide range. This is particularly useful with more vulnerable passengers like children and elderly.

LATCH (Lower Anchors and Tethers for Children) System

This is a must have especially for  family with children. Although all vehicles are now required to have the LATCH system to make car seat installation easier and more secure. This system has built-in lower anchors and top-tether attachment points that's designed to encourage the use of car seat for children.

Air Bag

Front air bags have been standard safety features on all new cars. Front air bags inflate to prevent passengers from hitting the dashboard, steering wheel and windshield. Side air bags on the other hand, reduce the risk that passengers will hit the  door or objects that crash through it. While airbags can saved lives, they may also cause potential injury or death if the passengers are not wearing seatbelts.

Lane Departure Warning Systems (LDW)

LDW systems alert you if you steer your car out of its lane without the turn signals activated. These systems use a camera or lasers to monitor lane markers.  If you leave your lane LDW may sound a chime, blink a dashboard telltale, and/or vibrate the steering wheel or seat.

Rearview Camera

Rearview camera is a tiny camera that is mounted on the back of the vehicle. It transmit an image to the dashboard or rear mirror to make it easier to see people or object behind you.

Enhanced Visibility

This safety feature, offered by some luxury cars, is an infrared night vision that can alert the driver with the hindrances waiting beyond the reach of the headlights. There are also some cars with adaptive headlights that shift when turning to help you see around curves.

Antilock Brake System (ABS)

ABS prevents a vehicle's wheels from locking during panic breaking. This allows the driver to maintain greater steering control that may avoid a collision, but it does not guarantee the ability to avoid crash. There will still be possibility of losing control when driving at excessive speed. Proper use of ABS can provide the greatest safety benefit from the system.

Forward Collision Avoidance System

This is system is also called pre-crash warning system that is often combined with automatic braking. This warning system alerts the drivers, with visual or auditory signals, if they're about to run into something.

Reverse Backup Sensors

This safety equipment, with or without the use of camera, helps alert you if you are about the collide with something.

Sideview Assist

This is particularly helpful a car is on your blind spot. The sensors on teh rear bumper will alert you with a light in the side mirror or with a beep if you turn signal.

Parking Assist

Parking assist feature is helpful for those who hates parallel parking. This feature can detect the size of the parking space then guide you into the starting position and the computer will back the car into place without you touching the wheel.

Traction Control

Traction control systems, mainly found in four-wheel vehicle antilock brake systems, improve the vehicle stability. The system controls the amount the drive wheel can slip when excessive power is applied. It automatically adjusts the engine power output and/or applies braking force to selected wheels during acceleration.

Electronic Stability Control

This electronic stability control technology helps correct a swerving vehicle by applying brakes on individual wheels thereby giving the drivers a chance to regain control.

Those are the latest car safety features must haves. If you plan to buy a new car, it's better to do some research first. You can check digital automotive classified sites like Cars.com to compare car models, its safety features, prices and more. Cars.com also has a large compilation of cars reviews that will help you decide with what cars to buy.

Always remember that these features are not substitute for safe, defensive driving. We must learn to drive safely  on the road and now the traffic rules.

Drive safely!

Project: Lightning McQueen Crochet Hat

Happy New Year to All! To start the year, I would like to share my last project for the year 2013 – the Lightning McQueen Crochet Hat.

Matt is a certified fan of Cars. He knows the major characters like McQueen, Hudson, Sally, Mater, Sheriff and Mac. He even called my service car as McQueen (Red Picanto), his Tito’s Pick-up as Hudson and our neighbor’s black car as Sheriff.

Last Christmas, we decided to have him a Cars-inspired outfit - clothes and shoes. To complete the set from head to foot, I made a Lightning McQueen crochet hat. Nakakakonsensya kasi yung sabi ni Mommy: “Andami natin nagawang hats for others this year, pero wala pa tayo nagagawa para kay Matthew.” This is one of the reasons why we closed the MTOs at Momaye’s Shoppe on the first week of December.
